A La Carte Floral Services Agreement & Policy

By placing an order for a la carte floral goods and services through KAE | Event Studio & Floral Boutique (“KAE”)—whether via website, proposal, or direct communication—you agree to the terms below.


1. Reservation & Confirmation

To secure your date/time and floral services, a non-refundable deposit (or full payment, depending on order size) is required. Once your deposit or payment is received, you will receive an email confirmation. That serves as proof of the agreement and date lock. Until deposit/payment is received, KAE does not guarantee availability of flowers, design staff, or delivery on that date.


2. Scope of Services

KAE is responsible only for those floral goods and services explicitly listed in your confirmed order (e.g. bouquets, centerpieces, installation, delivery, setup, breakdown). Any additions, substitutions, or changes beyond that must be submitted in writing and confirmed by KAE (subject to availability and possible extra charges). All floral product, vases, containers, floral foam, and related design materials are provided by KAE and are considered KAE’s property until/if sold to the client. KAE will both install and remove floral items as part of the service unless otherwise specified in writing.


3. Order Deadlines & Cut-Offs

Final design approval (quantities, styles, color palette, special requests) must be given at least 30 days before the event date. Within the cut-off window (after that deadline), changes may not be accepted, or may incur a rush or change fee. KAE is not obligated to fill orders or changes made after the cut-off time.


4. Delivery, Setup & Breakdown

KAE will coordinate delivery and setup within the agreed timeframe and venue access windows. Client must ensure venue access, loading zones, power, permission for hanging or installations, and safety compliance. Any delays or restrictions from venue, local rules, or other vendors affecting setup or breakdown times are the client’s responsibility. KAE is not liable for damage caused by third parties, guests, or venue staff to floral installations after the completion of setup.


5. Pricing, Payment & Fees

The confirmed order cost reflects floral materials, labor, design, delivery, setup, and breakdown as described. Unless otherwise agreed, full payment (beyond deposit) is due 30 days before the event (or on the event date, if agreed). A processing or convenience fee (4%) will be applied at checkout. Additional fees may apply for excessive travel, difficult access, last-minute changes, or after-hours work.


6. Cancellations & Refunds

The deposit is non-refundable under all circumstances. If the client cancels more than 30 days before the event, partial refunds (excluding deposit) may be issued at KAE’s discretion. If cancellation occurs within 30 days or on/near the event date, no refunds are available (all sales final). KAE may cancel due to extreme weather, force majeure, or catastrophic events; in such cases, KAE will attempt to notify the client and provide fair options (reschedule, partial credit, etc.).


7. Client Responsibilities & Cooperation

The client agrees to respond to KAE’s requests for selections, approvals, and logistics in a timely fashion (within 5 business days). Failure to respond or supply requested information may result in delays, order adjustments, or cancellation (without refund). Client must confirm any venue requirements (e.g. permissions, insurance, drapery, floor protection) and ensure safe installation conditions. Client is responsible for any damage to floral items or installations caused by guests, venue negligence, or third parties after setup is complete.


8. Liability, Indemnification & Limitation

KAE is not responsible for emotional distress, indirect damages, loss of enjoyment, loss of revenue, or punitive damages arising from floral services. KAE’s maximum liability is limited to the total amount paid for the floral services that are part of this agreement. Client agrees to indemnify, defend, and hold harmless KAE and its employees, agents, contractors from any claims, liabilities, damages, or losses arising from the client, guests, venue, or third-party actions (e.g. injury, property damage) relating to floral installations, open flame, water affects, hanging components, etc. KAE agrees to indemnify client only for its own actions or omissions (not for third party or client causes).


9. Photo & Media Release

The client grants KAE the right to photograph or film the floral designs at the event and use such media for promotional, marketing, social media, and portfolio purposes without further permission or payment. If there are sensitive guest privacy concerns or restrictions, the client must notify KAE in writing in advance.


10. Dispute Resolution & Legal Matters

The client agrees not to pursue legal action against KAE for issues arising from the floral services; all disagreements should first be attempted to resolve via written communication and good faith negotiation. If legal action proceeds, the client is responsible for any associated legal fees. This agreement is governed by the laws of the State of Colorado (or your jurisdiction).


11. Amendment & Updates

KAE reserves the right to update or revise this agreement and its policies. Clients will receive the version applicable at the time of their confirmed order. Clients cannot amend this agreement after confirmation unless agreed in writing by KAE.


12. Acceptance

By paying the deposit or full payment for floral services, the client acknowledges that they have read, understand, and agree to abide by all terms of this A La Carte Floral Services Agreement & Policy.
